Everyone who is going through a divorce wants to know what to expect from their alimony or spousal support plan: How long will it last? How much will it be? In Florida, there are no exact guidelines. A number of factors will affect the determination of whether or not alimony will be awarded and the length of time. For example, alimony will not continue after the death of the payor. Determining factors in Alimony and Spousal Support

There are a variety of important determining factors in the payment of alimony and spousal support. These factors include the length of marriage and the financial situation of the parties. The most important part of determining alimony is a simple two-pronged test: Does one party need it? Does the other party have the ability to pay? Have you been married long enough to be entitled to any? Even if you signed a prenuptial agreement, you may be able to obtain temporary alimony or temporary spousal support.

Types of Alimony

There are three types of alimony awarded in Florida courts. We will help you find the option that fits your needs and the financial situation of your former spouse:

  • Lump Sum Alimony: The paying party makes one large lump sum payment, one time. This payment type is common when the earnings capacity of one party is questionable.
  • Permanent Periodic Alimony: This type of spousal support is awarded on a monthly basis and will terminate upon the remarriage of the payee spouse. It is subject to modification based on changes in either spouse's financial situation.
  • Bridge-the-Gap Alimony: This alimony is designed to help a needy spouse back "on their feet". It is short-term and could include deposits for rent, electricity, and water.

Spousal Support Modifications

Unless you sign an agreement making your spousal support plan non-modifiable, all types of alimony are potentially modifiable. If there is a major change in the financial situation of either party, that person could apply to the court and petition for upward or downward modification of alimony. Major financial changes could include job loss, retirement, or medical concerns.
