In Florida, an annulment is not based upon the length of the marriage. You could have been married for one day and still not be entitled to an annulment of the marriage. However, there are certain criteria that must be met in order to annul the marriage, including:
- If you were forced into the marriage (such as a shotgun marriage)
- Marriage under duress
- Bigamy (most commonly in the form of one of the parties still being legally married to someone else without getting a divorce)
- Incest (marriage is void from the beginning)
- Non-consent (where one of the parties is underage)
Only the person who is innocent in the situation can seek and may be granted the annulment. It is possible for the innocent to receive attorneys' fees and other reimbursement for costs even though the couple was never legally married.
Marriage Fraud
Another permissible ground for annulment is known as "fraud in the inducement." In order to prevail on that ground, the fraud must go to the heart of the marriage. A common example of fraud in the inducement occurs when one of the spouses is a foreign national, and it is later discovered that their only purpose in marrying the citizen spouse was not love, but to obtain a green card.
Though they are rare, it is possible to obtain the annulment of a marriage in certain situations. Contact a lawyer at our office today to learn more about your options during a confidential consultation. Call us at 800-815-6577 or toll free at 888.757.0901.
