At our family law firm, our clients are our first priority. We understand many parents want to have primary residential custody of their children, and understand that every case is different. Whether or not you have ever been married, both parties are entitled to have a meaningful relationship with their child(ren).
Child Custody and Divorce
If you are going through a divorce, the future of your child(ren) will be an important issue in the future of your family. It is important that neither parent use child custody to attack the other parent. We will make sure that you find a child custody and visitation plan that protects your rights and works for you and your child(ren).
Understanding Child Custody
Child custody in Florida is divided into two categories: residential custody and parental responsibility. Residential custody reflects with whom the child primarily resides. Sole/Shared Parental Responsibility determines how the child is parented. Our family lawyer, Stephanie G. Morrow, will help you understand your options and come up with a plan that works for your family:
- Primary Residential Parent: The primary residential parent is the parent with whom the child(ren) primarily resides when one party is so designated. The other party will be responsible for child support and entitled to visitation.
- Shared Parental Responsibility: Shared parental responsibility is awarded in the majority of cases. The concept is that both parents should be involved with raising their child(ren). This custody arrangement is awarded where parents can work together in making major decisions in the upbringing of their child(ren).
- Sole Parental Responsibility: This arrangement is awarded where one of the two parents is unable or unwilling to co-parent.
Visitation
It is important for both parents to work together to develop a visitation schedule that protects their parental rights and works for their child(ren). If you are an involved parent who is not the primary residential parent, you are still entitled to as much visitation time as practicable.
